The European Court of Justice in Luxembourg has rejected the complaint of an Italian wine trading company that wanted to depict a rooster on the label for its trademark "Ghisu". This had previously been rejected by the EU Intellectual Property Office (EUIPO) in Alicante. The company then appealed to the European Court of Justice.

The Chianti Classico Consortium has long owned the trademark rights to the symbol of the "Gallo Nero", which its wineries display on their bottles. The court thus explicitly confirmed the exclusive use.The ruling led to "great relief" for the consortium and its director Carlotta Gori. "The ruling confirms our strategy to protect the brand, which we have been able to defend 61 times in the last 15 years," she said.
